Terms and Conditions

The Truro Forest School takes reasonable steps to manage and balance risks, while at the same time allowing children to play freely. Program participants acknowledge its inherent risks of harm and personal injury. While minor injuries like bruises, bumps and scrapes are not uncommon, serious injuries are rare, and life-changing injuries and fatalities are unlikely in the extreme. Still, as with almost any activity, indoors or outdoors, it is impossible to guarantee that they will not happen. You are required to accept this as a condition of your child’s participation.

At the Truro Forest School, all rules are designed to enhance the safety of your child and others and are to be followed at all times. In unstructured, outdoor play and learning, children freely choose which experiences and forms of play they are comfortable engaging in. Your child is under no obligation to participate in all experiences and may choose not to participate at any time during the program.

The variety of risks is more than can be listed here and will vary depending on the program. However, facilitators are trained and experienced, and their role is to support children in learning and playing, while keeping the risks to an acceptable level.

Below is a list of some of the more significant risks:
- Injuries from executing strenuous and demanding physical activities
- Injuries resulting from the presence of harmful plants, natural loose parts, wild animals, and/or ticks
- Changing and inclement weather, including storms, high winds, and lightning
- The possibility that your child may not heed safety instructions or directions given to the group or delivered individually
- Injuries arising from the actions of other children
- Negligence on the part of other participants

 

Acknowledgement and Assumption of Risk

I acknowledge that I am aware of the program details of the Truro Forest School and that there exist elements of risk, dangers, and hazards due to the nature of Forest School activities which may result in personal risk to my child including but not limited to the risk of serious injury or death. I willingly agree to assume responsibility and liability for those risks as a condition of registering my child for the program. I acknowledge that there are many known and unknown risks and dangers associated with being outdoors and participating in Forest School programs, including but not limited to collision with natural or man-made objects; collision with equipment or structures; slips, trips, and falls; collision with other persons; failure within one’s own ability to stay within designated areas; fatigue; stress; dehydration; allergic reaction; natural terrain; cliffs; trees, dead trees, tree wells, and tree stumps; creeks; rocks; boulders; forest deadfall; persons being separated from one’s party or guide; negligence of other persons; and NEGLIGENCE ON THE PART OF THE RELEASEE(S). I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT MY CHILD FROM THE RISKS, DANGERS, AND HAZARDS OF THE “Truro Forest School” ACTIVITIES. I acknowledge that there may be minor injuries such as bumps, bruises, cuts, insect bites or insect stings, concussions, broken bones, as well as the risk of serious injury or death. I acknowledge and understand these risks and grant permission to the employee of the Releasee(s) to call emergency assistance when required.

Release and Waiver of Rights, Including for Claims of Negligence, and Indemnity

I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless the Truro Forest School, any of their employees, facilitators, volunteers, agents, sponsors, officers, other participants and assigns from any and all claims, demands, or causes of action, which are in any way connected with my child's participation in the program or my use of the Truro Forest School’s equipment, including but not limited to injury, accidents, loss of property, death, disability, paralysis, sickness or exposure to other illnesses, and any such claims which allege negligent acts or omissions of the Truro Forest School. Should the Truro Forest School be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless (in other words, I agree to pay or reimburse the Truro Forest School) for all such fees and costs.
